Abstract

A study of the justiciability of fiscal transfer disputes and the institutional alternatives to adjudication.

Courts have been reluctant to enter transfer disputes, and rightly so.

The article defends that reluctance while proposing a statutory arbitral mechanism.

It concludes with a comparative note on three federations that have tried the same.
