Note on Third-Party Funding in Commercial Disputes

Meera Iyer

Meridian Law Chambers

Abstract

A short note on disclosure obligations, champerty concerns and the regulatory gap surrounding litigation funding.

Funding arrangements are no longer rare, but disclosure practice remains ad hoc.

The note sets out a minimal disclosure standard that courts could adopt without legislation.

It also flags the conflict-of-interest questions that arise when funders repeat across a docket.
